최영미 시인 배상 책임 없어”

뻔뻔스레 고소하는 사회 분위기 안 돼”
자신의 성추행 의혹을 폭로한 최영미 시인과
이를 보도한 언론사들을 상대로 10억원대 소송을
제기했던 고은(86) 시인이 패소했다.
서울중앙지법 민사14부(재판장 이상윤)는 15일 허위제보 및 보도 등을 이유로 고 시인이 제기한 손해배상청구 사건에 대해 “최 시인의 진술은 구체적이고 일관된 반면, 고 시인이 제시한 증거는 최 시인 진술이 허위라는 것을 입증하기에 부족하다”며 청구를 기각했다. 지난해 3월 최 시인은 한 일간지를 통해 “1994년 봄 고 시인이 서울 종로구 탑골공원 근처 술집에서 바지 지퍼를 열고 신체 특정 부위를 만져달라고 했다”고 주장했다. 그러자 고은 시인은 “허위 내용으로 명예훼손을 당했다”고 반박했다.
이에 대해 재판부는 “상황을 직접 목격했다는 진술이 있고, 이를 뒷받침할 최 시인의 일기도 증거로 제시됐다. 허위라 의심할 사정이 보이지 않는다”고 밝혔다. 언론 보도에 대해서도 “원로 문인인 고 시인의 성추행 의혹은 국민 관심 대상이 되므로 보도의 공익성이 인정된다”며 “사실적시에 의한 명예훼손 책임도 인정되지 않는다”고 판단했다.

선고 직후 최 시인은 입장문을 통해 “성추행 가해자가 피해자를 뻔뻔스레 고소하는 사회 분위기를 만들면 안 된다”며 “진실을 은폐하는 데 앞장선 사람들은 반성하기 바란다”고 밝혔다.
고 시인 성추행 논란은 2017년 최 시인이 계간지 <황해문화> 겨울호에 게재한 시 ‘괴물’이 고 시인의 성추행 행적을 묘사한 것으로 드러나면서 불거졌다. 거의 매년 노벨문학상 후보로 거론되며, 중·고교 교과서에 단골로 실리며 높게 평가됐던 고 시인의 글들은 이 일로 자취를 감추게 됐다.
시 ‘괴물’은 “En(은) 선생 옆에 앉지 말라고 / 문단 초년생인 내게 K(케이) 시인이 충고했다/ 젊은 여자만 보면 만지거든”이라는 내용으로 시작된다.

The Korean War
The Korean War was a war
fought in Korea between armies
from North Koreaand from South Korea.
The war began
at 4:30 AM on June 25, 1950.
Fighting stopped July 27, 1953.
More than
two million Koreans died,
Both sides blame each other
for starting the war.
The north, led by
communist Kim Il-Sung,
was helped mostly by
People’s Republic of China,
and the USSR.
There was medical support
from Hungary, Romania,
Czechoslovakia, Bulgaria
and Poland. Other support
came from Mongolia and India.
The south,
led by nationalist Syngman Rhee,
was helped by many countries
in the United Nations,
and especially by the United States.
The war did not end
but a ceasefire was put in place.
South Korea and North Korea are
still officially at war,
and the United States
still keeps troops in South Korea,
in case North Korea ever
invades again.
North and South Korea are
divided by
the Korean Demilitarized Zone
that crosses the 38th parallel.
